While your reservation is Pending, you have a 14-day period of exclusivity before that date becomes available again. Pending reservations will remain on our calendar, but the first client to submit payment will secure that date and time.

Accommodations

make sure your event meets our requirements

The dedicated space within your event must be at least 9 feet in diameter with access to at least 1 electrical outlet with 2 plugs. Access to fast reliable wifi allows us to deliver the videos to your guests quickly.

Shelter from the elements is mandatory and non-compliance may result in a nonrefundable cancellation of service. Our equipment is not weatherproof. If your event is outside, we require a space on level ground that is dry and protected from rain, mud, and direct sunlight.

This agreement is made by and between the Client(s) and the Creator (Spin 360, LLC). It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

Compensation: The Client agrees to pay Spin 360 the agreed upon percentage of the estimated total project cost before any services begin, and before any workable files are delivered. If the parameters of the Work change, evolve, or if it involves more time and detail than estimated, Spin 360 will inform the Client and they can renegotiate the Work’s cost.

Reservation: A signed contract and paid fees are required to reserve the dates and times of the event(s). If the event(s) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the Client, the retainer fees are non-refundable. The Client shall also be responsible for payment for any charges incurred up to time of cancellation.

Cancellation: Both parties understand that the Client or Spin 360, LLC may terminate the event service at any time if—for any reason—the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, the Client is still responsible for payment for all expenses incurred and any work done towards the completion of the project determined by Spin 360. Should the Client cancel less than 14 days before the event, the Client is responsible for full payment—as per the agreed upon estimate—plus all additional expenses incurred. In the event of cancellation, Spin 360 retains ownership of all work created.

Event Schedule: The Client agrees to confirm the schedule 14 days prior to the event(s). Notification of any changes in schedule or location must be made in a timely manner and confirmation of Spin 360’s receipt must be obtained by the Client. If the Client changes the event to a new date or new time that is unavailable for the Spin 360 team, the Client agrees to forfeit all monies paid.

Safety: Spin 360, LLC reserves to right to terminate coverage and leave the location of the event(s) if the operator(s) or any other team member(s) experiences unhealthy, inappropriate, threatening, hostile or offensive behavior from person(s) at the event(s); or in the event that the safety of the operator(s) or team member(s) from Spin 360 is in question.

Shooting Time / Additions: The Client and Spin 360, LLC agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Operation commences at the scheduled start time and ends at the scheduled end time. If the Client does not arrive at the appointed time for the event(s), shooting will remain at the scheduled start time and end time. Additional time beyond the scheduled end time will be billed to the Client.

Responsibilities: Spin 360, LLC is not responsible for compromised coverage due to causes beyond the control of the operator(s) or team member(s) including but not limited to obtrusive guests, lateness of the Client or guests, WiFi quality, weather conditions, schedule complications, incorrect or unclear addresses provided to the team member(s), rendering of decorations, or restrictions of the locations. Spin 360 is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the coverage. Spin 360 is not held liable for missed coverage of any part of the event(s). Spin 360 will not be held accountable for failure to deliver visuals of any individuals or any objects at the event(s).

Damage or Injury: The Client is liable and responsible for the behavior of all guests, event staff, and affiliates. In the event of injury, the Client assumes responsibility. If guests, affiliates, or the Client’s behavior results in damage to Spin 360’s equipment, The Client agrees to reimburse Spin 360 for the cost of replacement equipment. To prevent injury, Spin 360, the Client, and affiliates reserve the right to refuse service to any guest(s) who appear intoxicated or physically unfit to use the services.

Venue & Location Limitations: Spin 360, LLC is limited by the rules and guidelines of the location(s) and site management. The Client agrees to accept the technical results of their imposition on Spin 360. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; Spin 360 will offer technical recommendations only.

Film & Copyrights: The visuals produced by Spin 360 are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the Creator’s explicitly written permission. If the Client has purchased visuals from the Creator, upon final payment by the Client, limited copyright ownership of the resulting visuals will be transferred to the Client. Once the Client has purchased visuals from the Creator (Spin 360), the Creator grants the Client permission to share the visuals on social networking websites, with family and friends, and on vendor websites as long as the content remains unaltered and textual credit is explicitly given to Spin 360. The Client must obtain permission from the Creator (Spin 360) prior to publishing or selling the content. Unless strict confidentiality is requested by Client in advance of the establishment of this contract, Spin 360 can display materials and final work created for Client on Spin 360 website and social media accounts for promotional purposes.

Limit of Liability: In the unlikely event that the assigned operator from the Spin 360 is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the Spin 360 team, Spin 360 will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event(s).

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Spin 360’s control, including but not limited to camera, hard drive, or equipment malfunction, the Creator (Spin 360) liability is limited to the return of all payments received for the event(s). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Spin 360 is not liable for the loss of visuals beyond the lesser of the final delivery of all products included in the package or one year.

Once your event is approved, your overall vision for the design, as well as your logo and other required visuals must be submitted to us. Email them as an attachment to booking@Spin360.camera no later than 14 days prior to your event date.

The acceptable file format is .png with a transparent background. You will be allowed one revision of your design before finalizing.

Capture & Delivery: Spin 360 is not liable to deliver every image or video taken at the event if quality is deemed insufficient. The determination of visuals delivered to the Client is left to the discretion of the Spin 360.

Post-Production & Editing: The final post production and editing styles, effects, and overall look of the visuals are left to the discretion of the Spin 360 team.

Travel: The Client agrees to pay a $50 fee that covers travel, delivery, setup, and breakdown for standard Spin 360 events.

Additional Equipment

  • Vertical LED background lighting (Requires 12-14ft diameter for platform + lights)
  • Complementary LED Ring Light included for every event
  • Complementary prop money, money-gun, and/or bubble-gun, etc. are included at no additional cost

Setup: Spin 360 agrees to arrive at least 15-30 minutes before the event’s start-time in order to set up and prepare for guests. (Equipment setup takes 15 minutes).

Payment Schedule & Deposit: The payment plan shall occur in a collection of agreed upon payments. The first payment is a 50% non-refundable deposit due immediately upon receipt of the invoice; the total balance must be paid in full no less than two weeks before the event. (If the Spin 360 video booth service is booked less than two weeks before the event, the entire balance is due at the time of booking).

If the Client fails to make the final payment as specified, Spin 360 shall have the right to immediately terminate this agreement with no further obligation, while retaining any monies already paid.

Acceptance of Terms: Client promises to pay for the services rendered by Spin 360 for the Work as agreed upon. By paying a deposit or by completing the booking process below, Client agrees they have read, understood, and are considered legally bonded to these terms.
